If you create an account, you’re responsible for keeping credentials confidential and for all activity under your account.
 By providing your email/SMS, you consent to receive order updates, important service notifications, and optional marketing. You may opt out of marketing at any time (you’ll still get transactional emails).

Placing an order is an offer to buy products at the prices shown at checkout. We may accept or reject any order at our discretion (e.g., suspected fraud, availability). If we cancel an order after you’ve been charged, we’ll promptly refund the amount paid.

We may limit quantities per order/customer and may restrict sales by geography where required by law.

4) Pricing & Availability

Prices are listed in USD and may change without notice. We strive for accuracy but errors may occur. If a price error affects your order, we’ll notify you and give you the choice to proceed at the corrected price or cancel for a full refund.

  • You authorize us (and our processors) to charge your selected payment method for the total amount at checkout.

     

  • If a payment is declined, no order will be processed. You may need to use a different method.

We do not store full card details on our servers.

Purchases are also subject to our Shipping Policy and Return Policy (all sales final on consumables, with damaged/incorrect item remedy as stated). Those policies are incorporated by reference.

These Terms and your use of the Website are governed by the laws of the State of California, without regard to conflicts of law rules, and by applicable U.S. federal law.

Informal resolution first. Contact us to try to resolve any issue.
 Arbitration. If we can’t resolve it informally, disputes will be resolved by binding arbitration on an individual basis under the JAMS or AAA commercial rules (administrator to be mutually agreed) in [Sacramento County], California (or remote/virtual, if permitted). The arbitrator may award individual relief consistent with applicable law.
 No class actions. You waive the right to participate in class/representative actions.
 Small Claims. Either party may bring an individual claim in small-claims court in California within that court’s jurisdiction.

Jurisdiction/venue (injunctive relief). For IP or equitable relief, either party may seek relief in the state or federal courts located in [Sacramento County], California, and you consent to that venue and jurisdiction.

18) Severability; Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of future enforcement.

19) Entire Agreement

These Terms, together with the policies referenced above, constitute the entire agreement between you and New Incan Empire regarding the Website and supersede prior understandings.
